Terms of Use – FastDriver.eu

These Terms of Use govern access to and use of www.fastdriver.eu, an online platform connecting professional drivers and European transport employers.

By creating an account or using this website, users agree to comply with the conditions outlined below.

(i) using and maintaining individual User accounts on www.fastdriver.eu, powered by M2S Group and
(ii) enabling the Users to apply for job offers,
(iii) providing Recruiters with the CV Database by M2S Group, with its registered office at Prosta 20, 00-8, District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register.

                                                                                           § 1 - Basic Terms

Whenever in these Terms of Use the following names appear, they should be understood as follows:

  • Electronic Address – an ICT system that allows communication via electronic means, especially email.
  • CV Database – Dedicated section of the Website containing CVs uploaded by the Users in conformance with the provisions specified in these Terms of Use and stored on the server of the Administrator of the Website or its subcontractors.
  • CV – User's resume uploaded by them as an external file to their profile. It is available to employers, provided the User checks the box "I hereby give my consent for my profile data and CV to remain in the Website's CV database. The database is shared with the Website's partners, namely potential employers and entities acting on their behalf for recruitment purposes."
  • Commercial Information – Any piece of information directly or indirectly destined to promote products, services, or employer image, excluding the information enabling communication via means of electronic communication with a specific person, as well as information about products and services with no commercial purpose for the information provider, especially with no compensation or other gains from producers, retailers, and contractors.
  • Account/User Account – Set of information shared by the User while setting up an account or during later additions, which includes User Profile, CV, job offers recommended by M2S Group, recruitment history, preferred job offers, and tools enabling the User to manage the Account (settings).
  • Login – An email address used by the User on the Website
  • Employer – a natural or legal person, or other entity without legal personality, seeking contractors or service providers. The term also includes entities that serve as employment intermediaries, which have access to the CV Database granted by M2S Group.
  • User Profile – Information stored on the User Account, in particular about education, job qualifications, and career path, which is voluntarily given in a form at the moment of User account creation.
  • Terms of Use – "T" rms of Use" "or www.fastdriver.eu, powered by M2S Group, serve as terms of use pursuant to the Act on Providing Services by Electronic Means of 18 July 2002 (unified text of 9 June 2017, Journal of Laws 2002, No. 144, item 1204). The terms regulate:
    (i) the type and scope of services provided by M2S Group via electronic means,
    (ii) the terms of providing services by electronic means, including technical requirements and the ban on supplying illegal content,
    (iii) conditions for conclusion and termination of agreements made via electronic means,
    (iv) UsUsers'ersonal data processing,
    (v) complaint procedures.
  • Website – Website run by M2S Group at URL address: https://www.fastdriver.eu.
  • ICT System – Set of cooperating information technology devices and software assuring processing and storage as well as sending and receiving data through a telecommunication network via a terminal device adjusted to certain types of network, pursuant to provisions of the Act of 16 July 2004 Telecommunications Law (Journal of Laws of 2004 No. 171, item 1800 with later amendments).
  • Means of Electronic Communication – Technological solutions, including ICT devices and cooperating program tools, allowing long-distance communication with the use of data transmission via ICT systems, especially electronic mail.
  • Rendering Services via Electronic Means – Providing services by sending and receiving data (including digital compression and storage) via ICT systems on the individual request of the User without simultaneous presence of both parties and with the data being transferred via ICT networks, pursuant to provisions of the Act of 16 July 2004 Telecommunications Law (Journal of Laws of 2004 No. 171, item 1800 with later amendments).
  • Services – Every service rendered electronically by the service provider to the Users in compliance with these Terms of Use.
  • Service Provider or M2S Group – M2S Group Spółka z ograniczoną odpowiedzialnością with its registered office in Prosta 20, 00-850 Warszawa, Poland, District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register,
  • User (customer of Services) – A natural person using Services free of charge rendered electronically by the Service provider, including the use of the individual User Account.
  • GDPR – Regulation (EU) No 2016/679 of the European Parliament and of the Council of Europe of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and on the repeal of Directive 95/46/WE.

                                                                                        § 2 - General Conditions

  1. The Terms of Use regulate the way M2S Group provides services via electronic means of communication concerning:
    1. Maintaining the User Account by M2S Group and enabling the User to use it fully, including creating a User Profile;
    2. Receiving job offers corresponding to the criteria listed by the User;
    3. Applying by the User to job offers published on the Website.
    4. Servicing recruitment processes run by M2S Group at the request of third parties or sharing the CV Database with Employers.
  2. The Terms of Use are shared with Users free of charge upon request before agreeing to provide Services via the ICT system.
  3. M2S Group shall endeavour to provide stable and constant access to the Services described in these Terms of Use, except for some short-term interruptions which may be caused by maintenance works or conditions beyond M2S Group's control. M2S Group strives to limit the duration of any disruption of this kind.
  4. Services provided by the Website are free of charge for Users.
  5. Users are prohibited from publishing illegal content on the Website,  including content that infringes the rights and freedoms of third parties.
  6. M2S Group reserves the right to delete those User entries that breach the law, the rights of third parties, or the Service Provider. The Service Provider reserves the right to delete the User Account if the User uses the Account in any manner that violates the law, the Terms of Use, or the rights of third parties.

§ 3 - Terms and Conditions of Conclusion and Termination of Services Provided by Electronic Means of Communication

  1. M2S Group provides services on the grounds described in the Terms of Use. If the User does not accept the provisions of the Terms of Use, it is advised to limit its participation to applying for job offers without registering a User Account and to use the Website accordingly, or to abandon using the Website altogether.
  2. Users should be 18 or older.
  3. To use the Services provided by M2S Group, it is advised to fulfil the following technical requirements:
    1. Internet access,
    2. Internet browser.
  4. The Website allows Employers to publish their job offers.
  5. A User interested in finding a job offer may:
    1. Participate in a recruitment process with the Employer without setting up a User Account on the Website by clicking "Apply now. "In such circumstances, they are redirected directly to the Employer's Website, and M2S Group does not receive the User's personal data and thus cannot process it.
    2. Participate in the Employer's recruitment process by setting up a User Account on the Website.
    3. Participate in a recruitment process by using a form on www.fastdriver.eu powered by M2S Group. In such circumstances, the Employer is the Data Controller and M2S Group is the Data Processor. This course of action is available to both Users who have a registered User Account on the Website and those who do not.
  6. To set up a User Account, the User must complete a form published on the Website.
  7. Upon completing the form (which includes the User's personal data and acceptance of the Terms of Use), the User will receive an activation link at the specified email address. The Account becomes active upon the User clicking the link.
  8. By submitting a registration form, accepting the Terms of Use, and activating the Account, the User agrees to provide services via electronic communication. The User is granted access to their Account. The User receives an email notification about the Account creation and activation link sent to the email address provided during registration. During use of the Website, other notifications will also be sent to this email address, provided the User consents to receiving them.
  9. Setting up the AccoAccountnts gives the User full access to the interactive tools available on the Website, including:
    1. Creating a User Profile, which includes information on the User's qualifications, job qualifications, and career path. The User creates the ProfProfile by filling in a form.
    2. Uploading a CV file to the User Account;
    3. Receiving alerts of job offers corresponding to the criteria listed by the User in specific time periods specified by the User;
    4. Managing applications, which includes deleting them.
  10. M2S Group has no legal or real capacity to verify the data provided by the User. The User should be aware that providing incorrect or false data may prevent them from participating in the recruitment process.
  11. The User may delete their Account on the Website. To do so, they may either send an email to support@fastdriver.eu or, after logging in to the User Account, click Account Settings, then select the "Delete Account" button. By deleting it, the agreement to provide services via electronic communication is terminated.
  12. The User should not reveal their password to third parties. M2S Group is not responsible for any consequences arising from the disclosure of the password.

                                                      § 4 - CV Uploading Rules. CV Database Shared with Employers

  1. The User is entitled to upload an unlimited number of CV files on their User Account. Uploading a CV occurs by sending an external file. M2S Group may assist with the CV creation process by allowing the User to complete forms published on the Website.
  2. While uploading the CV to their User Account, the User may voluntarily agree to share it with Employers – either during Account setup or after logging in and clicking Account settings. If the User consents to the addition of their CV to the CV Database, the User Profile data (including personal data) and their CV files will be shared with Employers. The User may withdraw consent to the sharing of their ProfProfile in the CV Database by unchecking the box in their account settings.
  3. M2S Group grants access to their data to every User who puts their CV in the CV Database to enable them to verify or modify the data, reactivate the CV file, change, or remove the CV file or some data from the CV Database.
  4. M2S Group advises Users to update their accounts at least every 183 days. Within each such period, seven days before its expiration, the Service Provider will send the User an email containing a link to the Website where the User can update their Account. Accounts that have not been updated for over 2 years may be deleted.
  5. By placing a CV file in the CV Database, the User consents to the sharing of the full contents of their CV with entities that have access to the CV Database, namely the Employers as described in these Terms of Use.
  6. M2S Group shall endeavour to protect the User's personal data in compliance with the GDPR. M2S Group does not control or verify the data in CV files uploaded by the Users to the CV Database. The User is fully responsible for the contents of the CV put in the CV Database.
  7. M2S Group is not responsible for the inability to access the CV Database caused by circumstances that cannot be eliminated without incurring additional costs, or by third parties or acts of God. M2S Group may experience interruptions due to technical issues. M2S Group strives to introduce such interruptions at times when user activity is lowest and in the shortest timeframe possible.

                                                      § 5 - Privacy Policy and User Personal Data Protection

  1. User personal data will be processed in the following ways:
    1. Rendering services electronically based on the contract concluded with M2S Group through the User's acceptance of the rules of the Website, namely:
      (i) keeping an account on the Website;
      (ii) creating a professional profile;
      (iii) enabling the submission of applications for selected job offers on the Website;
      (iv) participation in future recruitments – in this case, the basis for the processing of the data will be the agreement concluded between the User and M2S Group under the terms and conditions set out in the rules of the Website.
    2. Evaluating the data provided and creating the professional profProfilethe User and matching the job offers registered in the Website with the UserUser'serience and qualifications, as well as transferring the recommended job offers – the basis for the processing of the UserUser'sa in this case shall be the justified interest of M2S Group relying on carrying out recruitment processes at the request of employers, as well as the provisions of the agreement concluded between the User and M2S Group under the terms and conditions set out in the rules of the Website.
    3. Providing the UserUser'ssonal data, processed in their professional profProfileated in the Website, to potential employers or entities working on their behalf, including recruiters, whose job offers are adequate to the UserUser'sfessional qualifications and experience – in this case, the basis for the processing of the data will be the justified interest of M2S Group relying on searching and matching the candcandidates'files to the job offers held by M2S Group, as well as the provisions of the agreement concluded between the User and M2S Group on the terms and conditions set out in the rules of the Website.
    4. Reminding the User, from time to time, to update the data on the Website – in this case, the basis of the processing will be the controller's legitimate interest, consisting of conducting recruitment processes based on the Website Users' data.
    5. Statistical ones for internal archiving needs of M2S Group – in this case, the basis of the processing will be a justified interest of M2S Group, and the statistical data resulting from the processing of the User's data for this purpose will not be made available to other entities.
    6. Marketing: if the User has given separate consent, the email address provided by the User will also be used to send commercial information concerning the controller's marketing activities related to the services offered by M2S Group. In this case, processing is based on the User's input, which the User may withdraw at any time by contacting M2S Group.
    7. Marketing, i.e., if the User has expressed a separate consent, the email address provided by them shall be processed also for the purpose of sending commercial information concerning the marketing activities carried out by the contcontroller'stners (among others potential employers or entities working on their commission), in particular concerning work in finance and education, to the email address provided by the User – in this case, the basis of the processing is the UserUser'ssent, which the User can withdraw at any time by contacting M2S Group.
    8. Archiving the conducted recruitment processes, confirming M2S GrouGroup'sfillment of its obligations resulting from the provisions on the protection of personal data, as well as vindicating the claims or defending against the claims which can be directed against M2S Group – the basis for the processing of the UserUser'sa in this case shall be M2S GrouGroup'sally justified interest, which is protecting the rights, claims, and confirming the fulfillment of obligations and obtaining due remuneration for this from M2S GrouGroup'sents, i.e., employers.
    9. Ensuring the correctness of the WebsWebsite'sctionianalyzingzing the UserUsers' visivisitors'ffic on the Website, which is described in detail in the section: Information on the use of cookies by the Website – in the case of the processing of personal data, the basis for the processing of the UserUser'sa shall be the justified interest of M2S Group, which is to ensure the functioning of the Website, its development and modification, and in some instances also the UserUser'ssent.
    10. Marketing, as well as aiming at the performance of the services, i.e., running pages in social media such as LinkedIn, Instagram, and Facebook – in the case of the processing of personal data, the basis for the processing of the User's data shall be M2S Group's legitimate interest, which is marketing of its own services and active acquisition of the Users.
  2. Independent of the above goals, M2S Group processes users' personal data in compliance with applicable law and ensures its accuracy and validity. As a result, M2S Group regularly notifies Users of updates to their data, either through profile notifications or by email to the Address registered in their profile. The User specifies the data to be shared with M2S Group. During registration, however, it is obligatory to provide the specific data necessary to provide the Services outlined in these Terms of Use and to conduct recruitment processes through the Website. Failure to provide the required data precludes registration on the Website and the submission of an application for a selected job offer.
  3. In addition to sharing your data with potential employers or entities acting on their behalf, we will also share your data with entities acting on our behalf, i.e., processors such as companies belonging to the capital group to which the controller belongs, which provide support services within the IT area, hosting providers, software providers, or IT support. The data will be made available pursuant to a data processing agreement, which will determine, among other things, the purpose, scope, and duration of processing of your data.
  4. M2S Group does not share your personal data with entities in third countries (i.e., countries outside the European Economic Area) unless the potential Employer or an entity conducting recruitment on its behalf (e.g., its subsidiary) has its registered office outside the EU. In such circumstances, if the European Commission has not issued a statement declaring a satisfactory level of data protection in this country, to provide it, M2S Group will sign an agreement with the entity, which will be compliant with either the standard data protection regulations proposed by the European Commission or a Polish supervisory authority. We would also like to inform you that all our IT service providers state that they host their servers within the European Economic Area. Nevertheless, some of these entities do not entirely preclude data access by entities outside the European Economic Area.
  5. M2S Group employs various IT organisational measures to minimise the risk of data leakage, destruction, or loss, including a firewall, antivirus software, internal access policies, and data processing procedures.
  6. User Data will be processed in the following periods:
    1. In the case of an application that does not register a User Account, M2S Group is not granted access to User data. The User shares their personal data directly with the Employer.
    2. If the User opens an Account, M2S Group will process the User's personal data until the User deletes the User Account from the Website, or for a period of 2 years from the most recent update to the Website.
    3. In the case of giving consent for participating in future recruitment processes, M2S Group will process the User's personal data until they formally withdraw their consent for processing (e.g., by deleting their User Account or changing their User Account settings) or for a period of 2 years from the most recent data update on the Website.
    4. After your Account is removed from the Website, for the period of limitation, we may process your data for storage or statistical purposes, to confirm our past obligations, or to pursue or defend against claims, but only for a period of no longer than 6 years.
  7. In compliance with GDPR, the User has a set of rights concerning the sharing of their personal data, such as:
    1. The right to information about how their personal data is processed. If any further questions arise, Users should contact support@fastdriver.eu.
    2. The right to access and update data may be exercised by contacting the Website at support@fastdriver.eu.
    3. The right to delete data may be exercised by sending an email to support@fastdriver.eu or by deleting the "Account" tab and its settings. In such circumstances, the Account will be removed from the Website, and the applications will be withdrawn from the current recruitment processes.
  8. In compliance with GDPR, the User is also entitled to:
    1. Demand a limitation of their personal data processing,
    2. Object to their data processing even if it is processed based on a legitimate interest,
    3. Transfer their data if the processing is based on an agreement or User consent.
  9. User rights will be exercised within 30 days of receiving their claim. If M2S Group is unable to meet this deadline due to unforeseen circumstances, M2S Group will inform the User and explain the delay. In justified cases, M2S Group may verify the User's identity by asking a few additional questions.
  10. M2S Group employs various ITorganizationalional measures to mitigate the risk of data breaches, data destruction, or data loss, including firewalls, antivirus software, internal access controls, and data processing procedures. M2S Group hereby informs you that the use of the Internet increases the risk of security breaches. We endeavour to minimise those risks.

                                                                                      § 6 - Claiming Procedures

  1. All User claims regarding the functioning of the Website and Services provided, which are described in the Terms of Use, can be sent to:
    (i) email address: support@fastdriver.eu
    (ii) via traditional post to M2S Group:

  2. Making a claim should contain at least the following:
    • Complaining entity (name, surname, Address, email address)
    • Object of the complaint, along with the description of the circumstances that give ground for the claim
    • Contact data
  3. M2S Group will review the claim within 14 days of receiving it. The information will be sent to the User in a manner corresponding to the way the complaint has been made, unless the User accepts another form of settling the claim.

                                                                                     § 7 - Final Provisions

  1. The service provider reserves the right to amend these Terms of Use, with such amendments taking effect on the date specified in the amendment, but no earlier than 14 days after notifying the Users of the changes. Within 14 days of being notified of amendments to the Terms of Use, the User may declare their refusal to be bound by the amended Terms of Use. Such a declaration will be understood as terminating the agreement between M2S Group and the User that formed the basis for the provision of the Services specified in the Terms of Use. Upon receiving this declaration, the Service Provider shall terminate providing the Services to the User within one working day from the filing of the declaration by the User. The declaration of refusing to be subject to the amended Terms of Use should be sent via email to support@fastdriver.eu or via registered mail to M2S Group, or by deleting the User Account.
  2. The service provider reserves the right to cease providing accounts on the Website free of charge without giving any reason. The discontinuation of providing such accounts constitutes the termination of M2S Group's Group's on of Services via electronic means of communication. It will occur after M2S Group informs the User within 14 days of delivering this information.
  3. In matters not covered by these Terms of Use, the universally applicable law shall apply, in particular the Civil Code, the Act on Providing Services by Electronic Means of 18 July 2002 (unified text of 9 June 2017, Journal of Laws 2002, No. 144, item 1204), the Personal Data Protection Act, and GDPR.
