Poland is a member of the European Union and the Schengen Area, has its own currency, and is the largest international road haulage nation in the Union by a wide margin. Its fleets run across the whole continent, its logistics sector is enormous, and it already employs foreign drivers in very large numbers. In June 2025, it rebuilt the legal framework for hiring them, and the changes are among the most consequential in Europe.
Citizens of the EU, the EEA, the EFTA states, Switzerland and the United Kingdom have free access to the Polish labour market and need no permit. For everyone else, this guide explains the new Act, the abolished labour market test, the electronic process, the declaration route, the salary rules, the costs and renewal — and gives professional drivers what is, on balance, the most open door in Europe.
A work permit — zezwolenie na prace — gives a foreign national the legal right to work for a specific employer, in a specific role, at a specific location, for a fixed period. One point catches people out constantly: a work permit only authorises work. It is not a residence title, so you still need a valid visa or residence card to stay in Poland legally. The permit types were consolidated into three main categories under the new Act, and applications are submitted to the competent voivodeship office.
The Act of 20 March 2025 on the conditions of admissibility of entrusting work to foreigners entered into force on 1 June 2025, superseding the old Act on Promotion of Employment and Labour Market Institutions. Two changes dominate. First, the labour market test was completely abolished. Previously, an employer had to obtain information from the starost confirming that the vacancy could not be filled by an unemployed Polish national registered with the labour office, and that step lengthened every case. Employers may now apply directly to the voivode without it. Second, the procedure became fully digital: since 1 June 2025, all applications for work permits, declarations on entrusting work, and all documents in those matters must be submitted exclusively in electronic form through the praca.gov.pl portal. Documents submitted in any other form are left without examination — paper filings are rejected without review. Filing requires a trusted profile or a qualified electronic signature, so employers must arrange those in advance.
The labour market test did not vanish without a replacement. Instead of testing each vacancy, authorities may publish lists of protected professions for which permits will be refused in specific districts, based on regional labour market needs. This is a blunter instrument than the old case-by-case test: rather than arguing your case, you either fall inside a closed occupation in that district or you do not. Such restrictions may appear during 2026, so the practical advice is to check the position for the specific voivodeship and district where the job sits before doing anything else.
Third-country nationals — anyone who is not a citizen of the EU, the EEA, the EFTA states, Switzerland or the United Kingdom. Those citizens have free access to the Polish labour market. Several categories are exempt under Article 3 of the Act of 20 March 2025, including researchers, graduates of Polish universities, certain holders of temporary residence permits, and family members of EU citizens. Note also that the Act does not cover every arrangement, which matters in practice because around 70 per cent of foreign workers in Poland are engaged under mandate or similar civil-law agreements rather than employment contracts.
A simplified route sits outside the standard work permit process. Citizens of Armenia, Belarus, Moldova and Ukraine can be employed based on a declaration on entrusting work to a foreigner — the oswiadczenie — registered at the poviat labour office. Georgia was removed from that list on 1 December 2025, which closed a route many Georgian workers had used. The rules also tightened: the fee jumped from PLN 100 to PLN 400 on 1 December 2025, and a copy of the signed employment contract must now be uploaded before the worker starts. For everyone else, the employer files a standard work permit application electronically at the competent voivodeship office.
Pay is regulated in two directions. From 1 January 2026, the salary floor for a full-time permit is PLN 4,806 gross a month, or PLN 31.40 an hour for civil-law contracts. Separately, and just as importantly, pay cannot be lower than that of comparable workers doing the same job. So a job offer must clear the statutory floor and be consistent with what the employer pays everyone else. For international haulage, where Polish drivers earn well above the statutory minimum, that floor is not the obstacle it is in some countries.
You need a written employment contract that complies with Polish labour law on minimum salary, working hours, and statutory entitlements from an employer who can file it electronically. The employer must confirm the role is not on a protected professions list in that district. Because the new Act tightened refusal grounds and raised penalties for illegal employment, employers are being noticeably more careful about compliance than they were, which is good news for a properly documented application.

Abolishing the labour market test removed the single longest stage of the old process, and full digitalisation has further reduced administrative delays. What remains is the voivodeship office’s own queue, which varies by region. The bottleneck for many people is now the residence side rather than the permit: remember the two are separate, and a work permit without a valid visa or residence card leaves you unable to stay.
Fees rose sharply from 1 December 2025 — up to four times higher in some cases — under the regulation of 20 November 2025 on the amount of fees related to work permit applications and declarations. The fee for a declaration on entrusting work is now PLN 400, up from PLN 100. Budget also for translations and any qualification recognition. Confirm the current schedule before you pay, since the implementing regulations have changed repeatedly.
A work permit is issued for a fixed period and is tied to the employer, role and location named in it, so a change to any of those generally requires a new permit. The new Act established the Central Register for the Employment of Foreigners, in which voivodes, poviat labour offices and the Border Guard post information on every decision issued, every notification submitted and the results of inspections. Oversight is now joined up in a way it was not before, and fines for illegal employment were raised alongside an expanded list of immigration offences.
Make sure your residence title is in place as well as your permit, since the work permit alone does not authorise your stay. Keep the contract, the permit, and the actual job aligned, because the register makes inconsistencies far easier to detect. If you are on the declaration route, note that the signed contract must be uploaded before you start — not afterwards.
Since June 2025, the pattern has shifted. Files fail because they were submitted on paper, which is no longer admissible at all; because the employer lacked a trusted profile or qualified signature; because the occupation is on a protected professions list in that district; because the salary falls below the floor or below comparable workers; or under the new, stricter refusal grounds the Act introduced. Georgian applicants relying on the old declaration route now fall entirely outside it.
Sort the electronic access first — a trusted profile or qualified electronic signature is now a precondition, not a convenience, and companies that leave it to the last minute lose weeks. Check the protected professions position for the exact district. Make sure the contract clears PLN 4,806 gross a month and matches what comparable staff earn. And plan the residence title in parallel with the permit rather than after it, because they are separate and only one of them lets you stay.
Polish labour law applies in full — minimum salary, working hours and statutory entitlements — and the requirement that your pay not be lower than that of comparable workers is a real protection against undercutting. The Central Register and the higher penalties for illegal employment have pushed employers toward compliance. Poland is in the EU and Schengen, so a lawful worker here sits inside the European labour and transport framework, and time on a residence card counts toward longer-term status.
If you are a non-EU driver looking at Europe, Poland is the most important country on the map. The Act and the portal are national, but the permit is issued by the voivode of the region where you will work — and the new protected professions lists are set district by district. So where the job sits now matters more than it did under the old labour market test.
